By accessing or using Analyze Your Knee ("the Service"), available at analyzeyourknee.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these Terms.

2. Nature of the Service — NOT Medical Advice

The Service is an informational and educational tool only. It is not a medical device, diagnostic tool, or healthcare provider. The Service does not provide medical advice, medical diagnoses, treatment recommendations, or clinical decision support.

All outputs generated by the Service, including but not limited to AI-generated analysis text, annotations, measurements, grading scores, reports, and consensus summaries (collectively, "Outputs"), are produced by artificial intelligence models and are provided solely for informational and educational purposes. Outputs may contain errors, inaccuracies, omissions, or hallucinated information.

You must not rely on any Output as a substitute for professional medical judgment. Always seek the advice of a qualified physician, radiologist, or other licensed healthcare professional with any questions regarding a medical condition, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of information obtained through the Service.

3. No Doctor-Patient Relationship

Use of the Service does not create a doctor-patient relationship, therapist-patient relationship, or any other professional healthcare relationship between you and Analyze Your Knee, its operators, contributors, or affiliates. The Service is not a licensed healthcare provider and does not practice medicine in any jurisdiction.

4. Assumption of Risk

You acknowledge and agree that:

• AI-generated analysis is inherently imperfect, experimental, and may produce incorrect or misleading results.
• The Service has not been validated or approved by any regulatory body (including the FDA, EMA, or equivalent authorities) for clinical or diagnostic use.
• You use the Service entirely at your own risk and assume full responsibility for any decisions made based on the Outputs.
• The Service is not intended to replace professional radiological interpretation or clinical decision-making.

5. Data Privacy & Local Storage

Your conversation history is stored locally in your browser using SQLite (via sql.js) and IndexedDB. We do not store, transmit, or retain your chat conversations on any server.

Uploaded medical images are temporarily processed on the server for AI analysis and are stored in isolated temporary directories that are automatically deleted within 24 hours. We do not retain copies of your medical images beyond this processing window.

6. User Responsibilities

You agree to:

• Use the Service only for lawful, personal, informational, and educational purposes.
• Not use the Service as a basis for clinical decisions without independent verification by a qualified healthcare professional.
• Not upload imaging data for which you do not have proper authorization or consent.
• Use the DICOM anonymization tool if uploading data that contains Protected Health Information (PHI) and you wish to remove it.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Outputs will be accurate, reliable, complete, or error-free, or that the Service will be uninterrupted, timely, secure, or free of defects.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANALYZE YOUR KNEE, ITS OPERATORS, DEVELOPERS, CONTRIBUTORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, HEALTH DETERIORATION, PERSONAL INJURY, MISDIAGNOSIS, DELAYED TREATMENT, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY OUTPUTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Analyze Your Knee, its operators, developers, contributors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your reliance on any Outputs, or your violation of these Terms.

10. Third-Party AI Services

The Service uses third-party AI models (including models from OpenAI, Google, Anthropic, and xAI) via API. These third-party services have their own terms of service and privacy policies. We are not responsible for the accuracy, availability, or behavior of third-party AI models. Your uploaded images may be transmitted to these third-party AI providers for analysis processing.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator resides, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.

13. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

14. Intellectual Property

The Service, including its design, code, user interface, and documentation, is the intellectual property of its operators and is protected by applicable copyright and intellectual property laws.

AI-generated Outputs are provided to you for your personal, non-commercial, informational use. You may share Outputs with your healthcare providers. We make no claim of ownership over user-uploaded content. You retain all rights to your medical imaging data.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Analyze Your Knee regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
